In these Terms of Service:

• "Fundify", "we", "us", "our" refers to the Fundify platform operated by Fundify.
• "Platform" refers to the website at fundify.isowebtech.com and any associated services.
• "User", "you" refers to any person who accesses or uses the Platform.
• "Founder" refers to a User who creates a startup listing on the Platform.
• "Investor" refers to a User who browses listings and contacts Founders.
• "Listing" refers to a startup pitch profile created by a Founder on the Platform.
• "Content" refers to all text, data, financials, images, and other material submitted to the Platform.

Fundify is a discovery and introduction platform that connects startup founders with potential investors. We are not a SEBI-registered investment advisor, broker, or intermediary under the Securities and Exchange Board of India (SEBI) Act, 1992, or any other applicable law.

Nothing on the Platform constitutes investment advice, financial advice, legal advice, or a recommendation to invest in any startup. All investment decisions are made solely at the discretion of the Investor. Fundify does not endorse, verify, or guarantee any Listing, Founder, or investment opportunity.

Startup investments are highly speculative and illiquid. You may lose your entire investment. Always conduct independent due diligence before investing.

You must be at least 18 years of age to use the Platform. By using Fundify, you represent that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding contract under Indian law.
• You are not barred from using the Platform under any applicable law.
• If registering as an entity, you have the authority to bind that entity to these Terms.

You must register for an account to access most features of the Platform. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and not share it with anyone.
• Notify us immediately of any unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

As a Founder, you represent and warrant that:

• All information in your Listing is true, accurate, and not misleading.
• You have the authority to represent the startup and seek investment on its behalf.
• Financial data, traction metrics, and team information are accurate as of the date submitted.
• You will promptly update your Listing if material information changes.
• You will not make any false or misleading statements to Investors.
• You acknowledge that misrepresentation to investors may constitute fraud under Indian law including the Indian Penal Code and the Companies Act, 2013.

As an Investor, you acknowledge that:

• You will conduct your own independent due diligence before making any investment decision.
• Fundify does not verify the accuracy of Founder claims.
• You will not harass, pressure, or intimidate Founders.
• You will keep all confidential information shared by Founders confidential.
• You are investing at your own risk and may lose your entire investment.

You agree not to:

• Post false, misleading, or fraudulent information.
• Impersonate any person or entity.
• Use the Platform for any unlawful purpose.
• Scrape, crawl, or extract data from the Platform without written permission.
• Transmit spam, unsolicited messages, or malware.
• Circumvent or interfere with the Platform's security features.
• Use the Platform to facilitate money laundering or other financial crimes.
• Contact Founders or Investors outside the Platform to circumvent our services.

The Fundify name, logo, design, and all Platform content created by us are protected by copyright and trademark law. You may not use our intellectual property without written permission.

By submitting Content to the Platform, you grant Fundify a non-exclusive, royalty-free licence to display, reproduce, and distribute that Content on the Platform for the purposes of operating the service.

To the maximum extent permitted by applicable law, Fundify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform or any investment made through connections formed on the Platform.

Our total aggregate liability to you for any claims arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹1,000, whichever is greater.

You agree to indemnify and hold harmless Fundify, its directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from your use of the Platform, your Content, or your violation of these Terms.

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us at [email protected].

Upon termination, your right to use the Platform ceases immediately. Sections 8, 9, 10, and 12 survive termination.

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
